On May 27, 2011, My Harvest America Inc. filed for Chapter 7 Bankruptcy Protection in the United States Bankruptcy Court for the District of Arizona. The Bankruptcy case number is 2:11-bk-15482 RTB. Mr. Eric Haley was appointed as the Chapter 7 Trustee ("Trustee") and is responsible for the investigation into the business operations of My Harvest America Inc. The Trustee has identified that a number of parties have improperly (and quite possibly fraudulently) reversed legitimate charges on their credit cards.
Reversing a charge on a credit card when you have received purchased goods and/or services may constitute fraud. The Trustee is in possession of electronic acknowledgements from thousands of cardholders that confirm a baseless chargeback constitutes fraud in accordance with the terms and conditions agreed to when receiving and activating gift card(s) sold by My Harvest America Inc.
The Trustee has engaged the law firm of Fennemore Craig, P.C. and has charged it with the responsibility to investigate and diligently pursue all individuals who improperly and/or fraudulently processed chargebacks after receiving goods and services from My Harvest America.
The Trustee intends to pursue legal action against any person who improperly charged back a transaction with My Harvest America. In addition to pursuing the recovery of improper and/or fraudulent chargebacks, if litigation is necessary the Trustee will seek interest on the funds, attorneys' fees spent in recovering the chargebacks and any other allowable charges.
The Trustee has taken control of the My Harvest America website, www.myharvestamerica.com, and has repurposed it to assist in the recovery of improper chargebacks and to provide information on the My Harvest America case.
If you are a previous customer of My Harvest America you may receive a letter from the Trustee or his counsel, Fennemore Craig, P.C. Please be aware it is a first and final demand letter from the Trustee. It won't be a first letter in a series seeking to collect on a debt. The Trustee's next step will be to file a lawsuit to recover the improper and/or fraudulent chargebacks. If you have already filed an improper chargeback and wish to reverse that process please contact your card issuer immediately, instruct them to reverse the chargeback and advise us immediately using the contact form on this website.
